GENERAL SALES CONDITIONS – GITE LA PETITE FEUILLE 

 

1. DEFINITIONS

Within these general rental conditions:

The term “Owner” means: Linda Gauffriau or her representative, 20 Montrepos, 85170 Les Lucs Sur Boulogne

The term “Tenant” designates: the person in whose name the reservation is registered as well as the person(s) that they themselves represent within this contract and for this rental period

The term “Accommodation” means: Gîte La Petite Feuille, 20 Montrepos, 85170 Les Lucs Sur Boulogne

 

2. RESERVATION AND DEPOSIT

To reserve the Accommodation, the Owner must pay the deposit according to the Payment Conditions (section 3 below).

Following the effective receipt of this deposit, the Owner will send the Tenant a confirmation email as a formal reservation agreement.

 

3. PAYMENT TERMS/SCHEDULE

For reservations made more than 4 weeks before the start of a stay:

- a deposit of 30% of the total price (excluding tourist tax) must be paid at the time of booking

- the balance must be paid 4 weeks before the start of the rental period

For reservations made less than 4 weeks before the start of the stay, the entire rental amount will be paid upon reservation.

 

 Payments will be made by bank transfer to the Owner's account indicated on the rental contract.

The Tenant will send proof of transfer to the Owner by email.

In case of paying failure within the deadlines established above, the reservation will be deemed canceled by the Tenant (see§ 6 Cancellation). Checks and cash are not accepted.

The tourist tax may vary each year, depending on the rate set by the municipality.

 

4. SERVICES INCLUDED AND CHARGES, OPTIONAL SERVICES

The rental price includes water and electricity. In winter, the price of overnight stays is calculated by including heating consumption. The Tenant will ensure reasonable heating, in the interest of sobriety. The Owner reserves the right to charge additional consumption in the event of excess.

 

Rental costs include:

-          Beds made on arrival

-          The supply of household linen (tea towels, hand towels and bath mats)

-          Internet access

-          Basic household products

-          Basic kitchen stock (salt, pepper, oil, spices, etc.)

-          Standard end-of-stay cleaning

 

The Tenant will be responsible for:

-          cleaning the kitchen (including ovens and hobs) and dining table

-          emptying and cleaning the fridge

-          waste disposal

-          emptying the dishwasher and storing clean dishes in the cupboards

-          proper flushing of toilets

-          sweeping the cottage

 

 The Tenant is also requested to remove the sheets and duvet covers from all the beds he has used on the day of his departure, including the pillowcases and pillowcases (except mattress pads), and to gather them together in the central room of the Accommodation on the ground floor.

 

The inventory, which lists the dishes, kitchen utensils and all equipment of the Accommodation, can be provided on demand before arrival and is available in the cottage.

 

Optional Services:

-          Free loan of baby equipment and furniture on prior request (travel cot, high chair, booster table, baby bath, bath chair, bath ring, toilet reducer, plastic potty, baby dishes).

-          Towel Kit: at the price of €6/person (Kit including one large and one medium towel) *

-          Late departure supplement between 10 a.m. and 4 p.m. on the day of departure, except July and August: + €100

 

 

5. DAMAGE and DEPOSIT

A security deposit in the amount of 1000 euros is established for any rental period in the form of a security deposit on the day of arrival or the day before by dematerialized CB imprint without debit.

 

Note: if the Tenant nevertheless prefers to deposit the deposit by bank transfer (return by bank transfer at the end of the stay), this transfer must be effective 3 working days before their arrival. The security deposit by check (checkbook in the name of the tenant with presentation of the corresponding identity document) remains possible. Cash is not accepted.

 

 Entry into the Accommodation will not be granted to the Tenant if the security deposit process has not been carried out before entering the premises. This deposit will be released at the end of the stay. It will be used to cover possible damage caused to the Accommodation, furniture (disappearance, tears, stains, breakage, burns, etc.), objects and exterior parts of the Accommodation, etc.

 

However, the sum reserved by this clause cannot limit the Tenant's liability towards the Owner and any damage whose amount exceeds that of the deposit must be covered in full by the Tenant.

 

The Tenant must, at the start of the rental, immediately report to the Owner or his representative any anomaly observed relating to the Accommodation and any failure concerning the equipment, machines and devices present in the Accommodation or in the garden so that his liability is released at the time departure. Measures will be taken to repair or replace any anomalies or failures observed as soon as possible.

 

6. CANCELLATION

Cancellation by the Owner within 8 weeks or more prior to the start of the stay will not result in any cancellation fees, and the Owner will reimburse all amounts paid.

 

In case of cancellation by the Tenant within a period of between 8 and 4 weeks before the start of the stay, the deposit paid will be retained by the Owner.

 

 In case of cancellation by the Tenant less than 4 weeks before the start of the stay, the total amount of the reservation will be retained by the Owner.

 

In case of cancellation by the Owner, a refund of all payments made for this reservation will be made to the Tenant. The Owner cannot be held responsible for any other loss, damage or inconvenience caused.

 

 

7. RENTAL PERIOD

Unless otherwise indicated or prior agreement with the Owner or payment of the late departure supplement, all arrivals are between 5:00 p.m. and 8:00 p.m. The departure time must be agreed with the Owner but must take place before 10:00 a.m. The Tenant is required to leave the premises at the times and dates set out in this contract without the possibility of extension, unless they have signed a new rental contract, or contracted late additional fees (see prices).

 

8. RESPONSIBILITIES OF THE TENANT

For reasons of insurance, comfort and good management of the rented property and in order to prevent any damage, Tenants are prohibited from exceeding the maximum number of 14 residents, including babies under 2 years old, in the Accommodation.

For reasons of possible allergies to animal hair of the following tenants, the presence of a pet is not authorized.

 

 If the number of Tenants exceeds the maximum capacity above or if the Tenant presents himself with an animal on arrival, the Owner or his representative may refuse entry to all Tenants, and if he does so, the contract will be broken and no refund will be required.

 If the Tenant contravenes these prohibitions during their stay, the Owner reserves the right to collect the entire security guarantee.

The Tenant further undertakes to use the furniture and objects for the purpose for which they are intended and not to transport them, unplug them, etc. inside the home or from/to the exterior or other rooms.

To bring additional beds is not authorized, except one baby cot. Likewise, it is prohibited to set up tents in the garden or in common areas of the estate, to light wood fires or fireworks, or to park caravans or camper vans there.

The Tenant may under no circumstances sublet or transfer its rights to this agreement to a third party, without the express consent of the Owner.

The Tenant undertakes to behave as a respectful user, to take care of the Accommodation and to leave it in a clean and tidy condition at the end of the rental period.

The Owner reserves the right to activate the security guarantee in order to cover additional cleaning costs in the event that the Tenant leaves the Accommodation in a non-compliant condition. The additional cleaning cost will be justified by the Owner using photos.

The Tenant also undertakes not to cause, through his behavior, any nuisance in any form whatsoever to the neighborhood (fields, crops and livestock nearby, animals in enclosures or in the wild (sheep, ducks, cats, dogs, etc.) ...), and will limit his comings and goings to the spaces which will be indicated to him upon his arrival (respect in particular the limits of the private garden of the Owner, residential house present on the site).

Day and night, the Tenant must ensure that all doors and windows are correctly closed during his absence from the Accommodation.

The Tenant will be held responsible for any loss or damage caused that cannot be covered by the Owner's insurance because it results from theft or illegal entry into the property facilitated by a failure to take the precautionary measures mentioned above.

 

9. ACCESS TO THE COTTAGE AND TRAFFIC CONDITIONS

The Cottage Gîte La Petite Feuille is accessible from the road network by first following on the GPS “La Virginie, Les Lucs Sur Boulogne”, then following the signs “Gite La Petite Feuille” or “Montrepos”.

Do not indicate “Montrepos” directly on the GPS (otherwise, you may arrive at another address that is not accessible).

Traffic on site is limited to 20 km/h.

 

10. RESPONSIBILITY OF THE OWNER

The Owner cannot be held responsible towards the Tenant:

 

-          any stoppage or temporary failure of the services serving the Accommodation (electricity, water, mobile network, internet, satellite TV) or of the equipment, plants, machines and appliances located in the Accommodation and its garden

-          noise or disturbances originating beyond the boundaries of the property, or which are beyond the control of the Owner

-          any temporary road closure required by the prefecture, town hall or any public body in the event of exceptional weather conditions and its consequences on access to the Accommodation,

-          any loss, damage or injury resulting from strikes or any other event beyond the control of the Owner.

The Owner cannot provide any guarantee concerning the safety of the Accommodation, its equipment or its exterior space, more particularly concerning children under 18 years of age.

 

The tenant is informed of the presence of an unsecured 1600 m2 pond near the Accommodation. Access around this pond and to certain areas of the site is authorized to the Tenant under his sole responsibility. The tenant's attention is drawn in particular to the risk of drowning for himself or any person in charge due to the presence of this water point. The Owner cannot be held liable, particularly in the event of an accident or failure to supervise children by the Tenant or those accompanying them.

 

The same applies to the possible approach of animals present on the property or nearby (ducks, sheep in enclosures, cattle (fenced fields), cats and dogs, and wild animals (deer, rabbits, hares in the wild). The Tenant will pay particular attention to the supervision of his children.

 

If the Tenant or his companions access the owner's private swimming pool located in his garden, he is informed that bathing is not supervised.

French safety standards are respected (NF P90-309).

The owners disclaim all liability if an accident should occur following improper use of the swimming pool or a failure to comply with the regulations posted in the accommodation, or even a lack of supervision.

 

 The Accommodation is equipped with a mezzanine with guardrail and stair railing meeting safety standards. The Tenant will, however, take care to prohibit any excessive support or escalation of these provisions in order to prevent any risk of accident, for which the owner cannot be held responsible.

 

The Accommodation is equipped with smoke detectors and a regulatory emergency circuit breaker, the only devices whose manipulation by the Tenant is authorized in the event of an emergency, to the exclusion of other elements of the electrical distribution panel.

 The liability of the Owner towards the Tenant cannot under any circumstances be incurred beyond the amount paid by the Tenant for the rental period in question.

 

11. INSURANCE

The Tenant is strongly advised to take out travel insurance (cancellation cover included) for himself, other participants in the stay as well as all their personal belongings. It is recommended to provide civil and bodily insurance in the event of an accident, as these eventualities are not covered by the Owner's insurance.

 

12. PETS

Pets are not allowed inside or outside the Accommodation, in order to prevent possible risks of allergies for the following Tenants.

 

13. NON-SMOKING ACCOMMODATION

Smoking is strictly prohibited inside the Accommodation, including by opening the windows. Under no circumstances should cigarette butts be thrown on the ground outside.

The use of electronic cigarettes inside the Accommodation is not authorized.

 

14. PROTECTION OF PERSONAL DATA (GDPR)

The personal data collected in the context of renting the property is used strictly for the purpose of managing and operating the rental, specifically to facilitate communication with tenants and ensure the smooth running of the stay. This data is in no way used for any other purpose, particularly commercial. It is neither sold nor shared with third parties. In accordance with the General Data Protection Regulation (GDPR), each tenant has the right to access, rectify, and delete their personal information upon simple request.

 

15. JURISDICTION

The Tenant acknowledges by signing the contract which will be sent to him by email that he has read all of the rules contained in this document.

 

The contract is not modifiable and is deemed to be accepted without reservation in its entirety by the parties. Erasures, modifications of any kind or correction or deletion of terms result in the contract being void.

 

The contract is governed by French law in each of its aspects, in particular its composition and interpretation, and must be considered as having been carried out in France. Any proceedings resulting from this contract, or in connection with it, may be brought only before the court of La Roche Sur Yon.
